1. Acceptance of Terms

By accessing or using this service, operated by Know Your Risk NZ (knowyourrisk.co.nz), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

Know Your Risk NZ provides property hazard information for Auckland addresses based on publicly available datasets from Auckland Council, LINZ, GNS Science, NIWA, and other government sources. Reports are generated automatically and are intended as a preliminary reference tool only.

3. No Professional Advice

The information provided does not constitute professional engineering, legal, environmental, or insurance advice.

Reports are based on publicly available datasets which may be incomplete, out of date, or inaccurate. You should not rely solely on our reports when making property purchasing, financing, or development decisions. Always obtain a LIM (Land Information Memorandum) report from the relevant council and engage licensed professionals (engineers, lawyers, surveyors) before making significant property decisions.

4. Accuracy of Information

While we endeavour to provide accurate and up-to-date information, we make no warranties or representations about the completeness, accuracy, reliability, or suitability of the hazard data presented. Hazard boundaries, flood zones, and risk classifications are derived from third-party datasets and may not reflect current conditions on a specific property.

5. Payments & Refunds

Paid reports are processed securely through Stripe. By purchasing a report you authorise the charge to your payment method.

Because reports are generated and delivered immediately upon payment, refunds are not available once a report has been generated, unless the report failed to generate due to a technical error on our part. In that case, contact us at support@knowyourrisk.co.nz within 7 days.

All prices are in New Zealand Dollars (NZD) and include GST where applicable.

6. Intellectual Property

All content, design, code, and branding on this service is the property of Know Your Risk NZ unless otherwise stated. Hazard data remains the property of the respective government agencies (Auckland Council, LINZ, GNS Science, NIWA). Reports purchased by users are licensed for personal, non-commercial use only. You may not resell, republish, or redistribute reports without written permission.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, Know Your Risk NZ shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or reliance on, this service or its reports. Our total liability in any circumstance is limited to the amount you paid for the relevant report.

8. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to scrape, automate, or bulk-query the service without written permission.
• Reverse engineer, copy, or reproduce the service or its outputs for commercial purposes.
• Misrepresent the source or nature of reports to third parties.

9. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. We may also update these Terms of Service; continued use of the service after changes are posted constitutes acceptance of the revised terms.

10. Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
