1. Acceptance of Terms

By accessing or using this service, operated by Know Your Risk NZ (knowyourrisk.co.nz), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

Know Your Risk NZ provides instant property hazard information for Auckland addresses based on publicly available datasets from Auckland Council, LINZ, GNS Science, NIWA, and other government sources. Reports are generated automatically and are intended as a preliminary reference tool to help you make more informed property decisions.

Know Your Risk NZ is an independent property information service. We are not affiliated with Auckland Council, LINZ, or any government body.

3. What This Service Is — and What It Is Not

A Know Your Risk NZ report is a summary of publicly available natural hazard data for a specific Auckland property. It is designed to help you understand potential hazard exposure early in the property buying process.

A Know Your Risk NZ report is not:

  • A substitute for a LIM (Land Information Memorandum) report from Auckland Council.
  • A substitute for professional engineering, legal, environmental, or insurance advice.
  • A guarantee that a property is free from hazard risk, even if no hazards are detected.
  • A building consent, resource consent, or compliance document.

Reports are based on publicly available datasets which may be incomplete, out of date, or subject to revision by the source agencies. You should not rely solely on our reports when making property purchasing, financing, or development decisions. Always obtain a LIM report from the relevant council and engage licensed professionals (engineers, lawyers, surveyors) before making significant property decisions.

4. Accuracy of Information

While we endeavour to provide accurate and up-to-date information, we make no warranties or representations about the completeness, accuracy, reliability, or suitability of the hazard data presented. Hazard boundaries, flood zones, landslide susceptibility classifications, and other risk designations are derived from third-party datasets and may not reflect current conditions on a specific property. Council datasets are updated periodically and our reports reflect the data available at the time of generation.

A "Not Detected" result for any hazard layer means only that the property boundary does not intersect the relevant mapped hazard extent at the time of report generation. It does not mean the property is free from that hazard risk.

5. Payments & Refunds

Paid reports are processed securely through Stripe. We do not see, store, or have access to your card details at any point. By purchasing a report you authorise the charge to your payment method.

Because reports are generated and delivered immediately upon payment, refunds are not available once a report has been generated, unless:

  • The report failed to generate due to a technical error on our part.
  • The report was generated for the wrong property due to a system error (not a user input error).

In either case, contact us at support@knowyourrisk.co.nz within 7 days of purchase. We will investigate and issue a full refund if the error is confirmed.

All prices are in New Zealand Dollars (NZD) and include GST where applicable.

6. Intellectual Property

All content, design, code, and branding on this service is the property of Know Your Risk NZ unless otherwise stated. Hazard data remains the property of the respective government agencies (Auckland Council, LINZ, GNS Science, NIWA) and is used under their respective open data licences.

Reports purchased by users are licensed for personal, non-commercial use only. You may share your report with your lawyer, mortgage broker, insurer, or other professional advisors as part of your property due diligence. You may not resell, republish, or redistribute reports for commercial purposes without written permission.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, Know Your Risk NZ shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or reliance on, this service or its reports. This includes but is not limited to: property purchase decisions made based on our reports, insurance or lending outcomes, or development or consent decisions.

Our total liability in any circumstance is limited to the amount you paid for the relevant report.

Nothing in these terms is intended to exclude or limit any rights you may have under New Zealand consumer protection law that cannot be lawfully excluded.

8. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Attempt to scrape, automate, or bulk-query the service without written permission.
  • Reverse engineer, copy, or reproduce the service or its outputs for commercial purposes.
  • Misrepresent the source or nature of reports to third parties.
  • Present a Know Your Risk NZ report as a LIM report, engineering assessment, or any other form of professional certification.

9. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. We may also update these Terms of Service; continued use of the service after changes are posted constitutes acceptance of the revised terms.

10. Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
